Time Cost LLC provides construction claims preparation, mediation, and arbitration services. Our fee structure is normally a moderate monthly fee for a fixed period plus a success fee based on a percentage of the final amount of the claim recovered.

Our typical functions have included claim development, claim presentation, mediation/arbitration, and claims collection. In this capacity, we review and summarize all project documents, such as initial project estimate, contracts, schedules, contract plans and specifications, correspondence, submittal logs, change orders, and payment requisitions. After this analysis is complete, all relevant data is registered into a timeline, which is footnoted with support backup exhibits. Using the completed timeline, we are able to efficiently complete delay analysis, such as “as-planned versus as-built baseline,” to determine how the project slipped and the party/parties responsible for the slippage. Contacts are made with the owner in an effort to negotiate the particular disagreement. These range from additional work, claims for a delay in the assessment of liquidated damages, and other back charges. When serving owners/sureties, functions have included claims analysis, document review, exhibit preparation, claims defense, and counterclaim. In the case of arbitration/litigation, tasks include offering support for legal activities in the form of expert testimony, evaluation of case strategy, job file research, information analysis, and case management. We are frequently called upon to help develop the scope of any case, identify strengths and weaknesses (of both sides), develop interrogatories, participate in depositions and settlement conferences, and aid in the development of trial technical presentations as needed.
